About the Terms of Service
Whenever you purchase a service from ItsJustHosting, you are required to agree to the terms of service outlined in this document. This agreement is automatically renewed every 30 days after the date of purchase unless you request a termination of the services. If you use ItsJustHosting's services, you MUST agree to the terms of service. No client using the services can claim that they did not or do not agree to the terms of service. Such claims will be met with a swift termination of services with no refunds. If you do not agree to the terms of service, please do not use our services.
Sites We Do Not Allow and Spam Policy:
ItsJustHosting does not allow the hosting of sexually explicit, racially hateful or politically/religiously controversial websites. We do not host porn sites, hate sites, proxies, warez sites (including linking) or sites deemed illegal under American, Canadian or European laws. Users found to have violated this term will have their accounts and sites terminated immediately with no refunds. In addition, accounts setup for the sole purpose of spamming will immediately be suspended or terminated with no refunds. If at any point ItsJustHosting has suspicions that your account is setup for the purpose of spamming, ItsJustHosting reserves the right to suspend or terminate your account, with or without notice. This is a strict policy and will be heavily enforced. If ItsJustHosting deems that your actions have caused any of ItsJustHosting's servers' IP addresses to be placed on blacklists or email filtering software systems, ItsJustHosting reserves the right to charge a $100 clean-up fee.
Content We Do Not Allow:
ItsJustHosting does not allow trademark infringement or copyrighted content (for which you are not the copyright holder), including but not limited to unauthorized copying of music, movies, books, images and other copyrighted content for which you are not the copyright holder. ItsJustHosting does not allow file storage sites, file upload and sharing sites, websites designed to direct traffic to other sites, or sites with the intent of giving away free hosting to the general public on its servers. Clients found to be hosting such sites will have their accounts suspended or terminated with or without notice. ItsJustHosting does not allow the use of shared, reseller or semi-dedicated hosting packages for file storage, the only exception being cPanel backups of your website content.
Examples of unacceptable content on Shared, Reseller and Semi-Dedicated Packages include proxy scripts, anonymizers, IRC bots, warez (pirated software), image hosting scripts (similar to PhotoBucket), file dump scripts, RapidLeech (similar to RapidShare), commercial audio streaming, IP Scanners, AutoSurf sites, Mail bombers, Spam scripts, commercial banner ad services, Escrow/bank debentures, high yield interest programs, investment sites, MUDs/RPGs, sale of any controlled substance, lottery sites, hateful/racist websites, adult websites, hacker oriented sites, sites promoting illegal activity, websites or forums that include or link to pirated software (warez) and fraudulent websites.
Examples of unacceptable content on Virtual Private Server, Dedicated Hybrid and Dedicated Server packages include IRC bots, warez (pirated software), IP Scanners, AutoSurf sites, Mail bombers, Spam scripts, commercial banner ad services, Escrow/bank debentures, high yield interest programs, investment sites, sale of any controlled substance, lottery sites, hateful/racist websites, adult websites, hacker oriented sites, sites promoting illegal activity, websites or forums that include or link to pirated software (warez) and fraudulent websites.
We reserve the right to refuse service to anyone and to remove any material that, in our judgement, is deemed obscene, threatening or illegal from our servers without notice. ItsJustHosting is in no way responsible for ensuring that scripts/programs installed under your account are secure, with directory permissions set properly. You are responsible for all actions taken under your account, including any compromise of personal information, such as usernames and passwords.
Payment:
You are responsible for the full (100%) payment of the then current charges for the receipt of ItsJustHosting's services. All charges must be paid in advance. For example, the purchase of a monthly service requires payment be made on the date of purchase. The next payment is then due 29 days after the day the service was purchased, at 11:59PM should you decide to continue using the service. A reminder for this payment will be sent via email a week before payment is due. If the user cannot meet the payment deadline for any reason, they must notify ItsJustHosting a day before the deadline at the latest with a valid reason. ItsJustHosting may then extend the deadline to accommodate the concern. ItsJustHosting will suspend accounts if payment is not paid by 7 days after the date the invoice is due. Payments paid after this are subject to $5 late fee, in addition to the owed amount. If the user fails to make even a late payment after this one week, the account will be terminated.
It is your responsibility to ensure all your payment information is up to date and all invoices are paid on time and in full. It is also your responsibility to notify ItsJustHosting in writing when you wish to cancel a service, and you agree that unless you do so, you will continue to be billed for the service(s) on a recurring basis. ItsJustHosting offers a money back period for various products. To learn more about this, please read our Service Level Agreement (SLA) here.
Website Transfers:
ItsJustHosting offers website transfers from your old host as a courtesy service, and while ItsJustHosting will make every effort to try and transfer your files, ItsJustHosting does not guarantee the success of these efforts. This courtesy service of transferring files applies only if the host being migrated from uses the cPanel control panel, and only to shared, semi-dedicated, VPS, hybrid and dedicated server packages. Reseller clients must pay the appropriate transferring fee and have their accounts on a cPanel web host.
Promotions:
Unless otherwise stated on a specific promotion's web page, any discount offered by ItsJustHosting is valid only for the first month. For example, unless otherwise stated, a promotion advertising 40% off refers to 40% off your first month of the service and NOT off every month for the whole duration of the service if the service exceeds one month.
Refund Policy:
Outside of the money-back period outlined in ItsJustHosting's Service Level Agreement (SLA), all payments made to ItsJustHosting are non-refundable. This includes but is not limited to product add-ons (dedicated IPs, WHM Access etc…), and domain names. All payments made to ItsJustHosting for virtual private server packages, dedicated hybrid packages and dedicated servers are non-refundable.
Payments made on an annual basis will not be refunded outside of the money-back period outlined in ItsJustHosting's Service Level Agreement (SLA). In other words, if you purchase a service and choose to pay it on an annual basis, and you are outside of the money-back period, you are not eligible to receive a refund unless at ItsJustHosting's discretion. Any abuse of our staff will be met with suspension or termination. ItsJustHosting reserves the right to cancel or terminate any account at any time with or without notice.
Resource Usage:
90% or more of your content on your website must be linked from an HTML, PHP or similarly coded web page where all content is freely available to the public. Your website must consist of web pages of a standard design, essentially HTML based text and graphics. Downloadable files, media, streaming content or any file which consumes more than 10000kb of space must not exceed 10% of your total used disk usage.
Users may not:
1) Use 25% or more of system resources for longer than 90 seconds.
2) Run IRCD or standalone server side unattended processes.
3) Run Cron jobs that in intervals of less than 15 minutes.
4) Run gaming servers, process game server stats, teamspeak, ventrillo or any other voice application, torrents, torrent related sites, trackers or applications.
5) Run any processes related to or that interface with IRC programs and or networks.
6) Run any kind of web indexer or web spider.
7) Repeatedly create and delete large numbers of files on a regular basis causing system damage.
8) Chat scripts and chat servers.
Memory usage may not exceed 15% per account/file/application.
CPU usage may not exceed 15% per account/file/application.
Apache connections may not exceed 40 connections.
20 MySQL maximum user connections allowed.
60 emails per hour, per domain.
Storage and Bandwidth Usage:
Every ItsJustHosting account includes a limited and defined storage and monthly bandwidth limit. You are responsible for ensuring your storage and bandwidth usage stays within this limit. Should your storage and/or monthly bandwidth usage exceed the amount allocated with your plan, ItsJustHosting reserves the right to suspend your account until the start of the next allocation, or until you purchase more resources or upgrade to a higher plan. You will be billed for storage and bandwidth usage beyond the allocated amount at the rate of $1 per GB of storage and $1/GB of Bandwidth. You cannot carry over unused bandwidth from one month to the next month.
Reseller Responsibilities:
All ItsJustHosting resellers are responsible for providing support to their clients, as ItsJustHosting does not provide support to reseller's clients. Resellers are also responsible for all content stored and transferred on their clients' accounts, and must make sure both they and their clients do not violate these terms of service. Shared and Semi-Dedicated users are not allowed to resell their accounts or resources to others.
Price Change Policy:
The price you pay for any of ItsJustHosting's services will never increase from the date of purchase without prior notice. ItsJustHosting reserves the right to change prices listed on its website (ItsJustHosting.com) and the right to increase the amount of resources allocated with a any plan at any time.
Incorrect Charge Policy:
If you discover that ItsJustHosting has incorrectly charged you for a service, you are required to promptly contact ItsJustHosting by opening a support ticket from your client area, and explain your position. If you choose to resolve the issue in any other way, you are responsible for any charges incurred.
Backups and Data Loss:
ItsJustHosting performs daily and nightly offsite backups with shared and reseller plans, as well as daily offsite backups with semi-dedicated plans. Recovery of these backups is reserved only for cases of catastrophic hardware failure or other emergencies at ItsJustHosting's discretion. In addition, even backups are prone to failure, and ItsJustHosting recommends you backup your data regularly and off of ItsJustHosting's servers. ItsJustHosting reserves the right to charge a $35 data recovery fee if deemed appropriate. ItsJustHosting is not responsible for lost or damaged files and/or data.
Disclaimers:
Your use of ItsJustHosting's service(s) is at your own risk. ItsJustHosting shall in no way be held responsible for any damage you or your business may suffer. ItsJustHosting makes no warranties of any kind, expressed or implied for services it provides, and shall not be held responsible for damages incurred from loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by ItsJustHosting.
Changes to Terms:
ItsJustHosting reserves the right to modify any part of the terms of service at any time without notice.
