In exchange for fees paid in advance, ItsJustHosting (“IJH”) agrees to provide services to the subscriber of those services (“client”, “you”) subject to these terms of service. IJH will provide the services according to the specifications of the package that the client selects in the IJH order form.
As a client you agree to the terms of service outlined in this document.
Fees and Payment
The initial service term for the provided services shall begin on the date that IJH generates an e-mail message to the client announcing the activation of their account. This term shall continue for the stated number of months in the client’s order form. This “service term” will be renewed automatically at the end of each term and will be subject to payment of the recurring charges. Establishment of any services by IJH to the client is dependent on the receipt of payment of the stated charges by IJH. IJH emails renewal notifications 10 days before the payment due date, 1 day after the payment overdue date, 3 days after the payment overdue date and 6 days after the payment overdue date. Payment made to IJH for charges that are overdue beyond 6 days is subject to a $10 late fee.
Service will be interrupted on accounts that are overdue by 7 days. IJH reserves the right to suspend accounts for non-payment at its discretion. For managed VPS, managed hybrid and managed server services, IJH reserves the right to charge a $30 reconnection fee in order to reconnect services interrupted for non-payment. IJH will only re-activate services that have been deactivated for non-payment once payment is received in full by IJH.
Refund Policy
IJH provides a 15 day money back guarantee only for Business web hosting packages (itsjusthosting.com/web-hosting). The client must contact IJH by submitting a support ticket from their Client Area to IJH’s billing department requesting a refund not more than 15 days from the initial service term for this guarantee to be valid. Refund requests are not accepted through any other method of contact, and only the authorized account holder may request a refund. All payment made to IJH for service add-ons including but not limited to domain names, SSL certificates and IP addresses are non-refundable. Violation of the terms of service herein will void this money-back guarantee.
All payment made to IJH for managed VPS, managed hybrid and managed server packages or any other additional fees relating to these services are non-refundable. The Client shall not be entitled to any refunds, pro-rated or otherwise relating to the termination of these services.
Cancellation Policy
Cancellation requests must be submitted in a support ticket opened from the client area by the client with IJH’s billing department at least 7 days and no later than 30 days before the end of the service’s billing cycle. This is the only form of contact through which cancellation requests are accepted, only the authorized account holder may cancel the account.
Price Change Policy
The price you pay for any of ItsJustHosting's services will never increase from the date of purchase without prior notice. ItsJustHosting reserves the right to change prices listed on its website (ItsJustHosting.com) and the right to increase the amount of resources allocated with a any plan at any time.
Additional IPs Policy
All IP addresses assigned to the Client must be justifiable per ARIN guidelines at http://www.arin.net/policy/nrpm.html. Any IPs that are determined to not be in accordance with these guidelines may be revoked. Should the client request more IPs than provided with the purchased package, IJH will only provide the IPs if it is determined that they will be used in accordance with the above ARIN guidelines.
SPAM Policy
IJH has a zero tolerance policy towards spam and the sending of Unsolicited Commercial Email. If IJH determines that the client is using any services to send SPAM, the offending account may be suspended or terminated at IJH’s discretion, with or without warning. If IJH deems that the client’s actions have caused one of IJH’s server’s IP addresses to be placed on blacklists or email filtering software, IJH reserves the right to charge a $100 clean-up fee.
Content We Do Not Allow
ItsJustHosting does not allow trademark infringement or copyrighted content (for which you are not the copyright holder), including but not limited to unauthorized copying of music, movies, books, images and other copyrighted content for which you are not the copyright holder. ItsJustHosting does not allow file storage sites, file upload and sharing sites, websites designed to direct traffic to other sites, or sites with the intent of giving away free hosting to the general public on its servers. Clients found to be hosting such sites will have their accounts suspended or terminated with or without notice. ItsJustHosting does not allow the use of shared, reseller or semi-dedicated hosting packages for file storage, the only exception being cPanel backups of your website content.
ItsJustHosting does not allow the hosting of sexually explicit, racially hateful or politically/religiously controversial websites. We do not host porn sites, hate sites, proxies, warez sites (including linking) or sites deemed illegal under American, Canadian or European laws. Users found to have violated this term will have their accounts and sites terminated immediately with no refunds.
Examples of unacceptable content on all servers include proxy scripts, anonymizers, IRC bots, warez (pirated software), image hosting scripts (similar to PhotoBucket), file dump scripts, RapidLeech (similar to RapidShare), commercial audio streaming, IP Scanners, AutoSurf sites, Mail bombers, Spam scripts, commercial banner ad services, Escrow/bank debentures, high yield interest programs, investment sites, MUDs/RPGs, sale of any controlled substance, lottery sites, hateful/racist websites, adult websites, torrents, torrent trackers, hacker oriented sites, link shortening/protecting sites, sites promoting illegal activity, websites or forums that include or link to pirated software (warez) and fraudulent websites.
IJH does not allow the advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this agreement which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks on any of its servers.
VPS/Hybrid Resource Usage
IJH VPS and hybrid accounts operate on shared resources. Excessive use or abuse of these shared resources by one customer may have a negative impact on all other customers. You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of the service.
Business Web Hosting Resource Usage
The following applies only to IJH business web hosting plans found at itsjusthosting.com/web-hosting
90% or more of your content on your website must be linked from an HTML, PHP or similarly coded web page where all content is freely available to the public. Your website must consist of web pages of a standard design, essentially HTML based text and graphics. Downloadable files, media, streaming content or any file which consumes more than 10000kb of space must not exceed 10% of your total used disk usage.
Users may not:
1) Use 25% or more of system resources for longer than 90 seconds.
2) Run IRCD or standalone server side unattended processes.
3) Run Cron jobs that in intervals of less than 15 minutes.
4) Run gaming servers, process game server stats, teamspeak, ventrillo or any other voice application, torrents, torrent related sites, trackers or applications.
5) Run any processes related to or that interface with IRC programs and or networks.
6) Run any kind of web indexer or web spider.
7) Repeatedly create and delete large numbers of files on a regular basis causing system damage.
8) Chat scripts and chat servers.
Memory usage may not exceed 15% per account/file/application.
CPU usage may not exceed 15% per account/file/application.
Apache connections may not exceed 40 connections.
20 MySQL maximum user connections allowed.
200 emails per hour, per domain.
Storage and Bandwidth Usage
Every ItsJustHosting account includes a limited and defined storage and monthly bandwidth limit. You are responsible for ensuring your storage and bandwidth usage stays within this limit. Should your storage and/or monthly bandwidth usage exceed the amount allocated with your plan, ItsJustHosting reserves the right to suspend your account until the start of the next allocation, or until you purchase more resources or upgrade to a higher plan. You will be billed for storage and bandwidth usage beyond the allocated amount at the rate of $1 per GB of storage and $0.25/GB of Bandwidth. You cannot carry over unused bandwidth from one month to the next month.
Migration Service
All account transfers, website moves, or any other similar transfers (hereafter known as “transfer”) as a courtesy service only. By requesting IJH perform a transfer, you agree to indemnify and hold harmless IJH from any and all liability arising from the transfer/copying of your accounts. IJH does not guarantee the success or completeness of any transfer, nor will IJH be held responsible for any damage or fees incurred by you in the transfer process.
Data Backups
IJH performs weekly backups of VPS accounts as a courtesy service only. These backups are reserved only in case of hardware failure or disaster recovery. IJH recommends you have your own backup system in place, and IJH does not guarantee and is not responsible for the completeness, integrity or freshness of your VPS backup. If backup restoration is requested for purposes other than disaster recovery or node failure, IJH reserves the right to charge recovery fees at its discretion.
Abuse and Harassment
IJH has a zero tolerance policy towards the abuse and/or harassment of its staff. This includes verbal harassment, threats, swearing, yelling or rudeness. Any such abuse will be treated as a violation of this terms of service, and may lead to service suspension or termination.
Disclaimer
Your use of ItsJustHosting's service(s) is at your own risk. ItsJustHosting shall in no way be held responsible for any damage you or your business may suffer. ItsJustHosting makes no warranties of any kind, expressed or implied for services it provides, and shall not be held responsible for damages or fees incurred from loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by ItsJustHosting.
Force Majeure
You agree that IJH is not responsible for any damages, delays, or other failures to fulfill its obligations hereunder as a result of war, fire, strike, riot or insurrection, natural disaster, delay of carriers, governmental order or regulation, complete or partial shutdown of plant, unavailability of materials or equipment from suppliers, failures or blackouts, labor disputes, and/or other occurrences beyond its control whether or not similar to those listed above.
Miscellaneous
IJH reserves the right to refuse service to anyone and to remove any material that, in our judgement, is deemed obscene, threatening or illegal from our servers without notice. IJH is in no way responsible for ensuring that scripts/programs installed under your account are secure, with directory permissions set properly. You are responsible for all actions taken under your account, including any compromise of personal information, such as usernames and passwords. IJH reserves the right to modify any part of the terms of service at any time with out notice. You agree that it is your responsibility to periodically check the terms of service for any modification. Your continued use of the services after such modifications will constitute your acknowledgment of the modified terms of service and agreement to abide and be bound by the modified terms of service. If you do not agree to these terms, please contact us to cancel your services.
